Legionella Risk Assessments.

 
A lot of emphasis is put on making sure Gas safety certificates are in place before the start of the tenancy, and more recently the new regulations for the safety of Electrical installations and portable appliances.


Gas safety certificates have been a legal requirement since 1994.


EICR’s and PAT testing will become a legal requirement for all rental properties by the end of 2016.


So what about Legionnaires Disease risk assessment?
Q – Is this a legal requirement?
A – YES. 


Landlords have a duty of care to carry out a risk assessment of hot and cold water systems for Legionnaires disease.


Under the Control of Substances Hazardous to Health Regulations 2002, landlords are responsible for ensuring that the risk of exposure to legionella in rented property is properly assessed and controlled.

The Health and Safety Executive changed the legislation in 2012, and issued further guidance for landlords in 2014.


This was followed by guidance issued by the Scottish Association of Landlords in late 2014
